We comply with both the "Copyright Disclaimer Under Section 107 of the Copyright Act 1976" and the Canadian "Fair Dealing" provisions.
Fair Use (US Copyright Law)
Under the US Copyright Act 1976, Section 107 allows for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is allowed by the copyright statute and might otherwise be infringing. Non-profit, educational, or personal use typically supports a fair use claim.
Section 107 provides:
- Purpose and Character: Nonprofit educational use is favored.
- Nature of Work: Consideration of the type of work used.
- Amount and Substantiality: The portion used relative to the whole work.
- Effect on Market: Impact on the work's market or value.
Fair Dealing (Canadian Copyright Law)
Fair dealing in Canada is a statutory exception to copyright infringement, often referred to as a user's right. According to the Supreme Court of Canada, it's more than a simple defense; it's an integral part of the Copyright Act, balancing the rights of owners and users. To qualify under fair dealing, the use must be for a purpose listed in sections 29, 29.1, or 29.2 of the Copyright Act (such as research, private study, education, parody, satire, criticism, review, or news reporting) and must be considered fair according to criteria established by the Supreme Court.
